političeskogo liberalizma ego amerikanskogo kollegi Dž. Rolza. Ostanavlivajas′ na neskol′kich ključevych temach, Melkevik rassmatrivaet kritiku modeli političeskoj i individual′noj avtonomii Rolza, osobennosti ego moral′nogo diskursa o demokratii v sravnenii s kommunikativnoj model′ju demokratii CHabermasa.
Issledovanie podčerkivaet nekotorye nedostatki teorii Rolza v otnošenii k juridičeskoj sovremennosti i predlagaet al′ternativnoe rešenie, v bol′šej stepeni orientirovannoe na intersub′′ektivnye otnošenija, kommunikaciju i demokratiju.
This collection of essays by the outstanding Canadian scholar B. Melkevik focuses on the question of democracy in the works of J. Rawls and J. Habermas. The author analyses the criticism expressed by J. Habermas regarding the concept of political liberalism of his
American colleague J. Rawls and on the defense of Rawls as to this concept. The author considers the criticism of Rawls’s model of political and individual autonomy, the peculiarities of his moral discourse on democracy in comparison with the communicative model of
Habermas’s democracy.
This study highlights some of the drawbacks of Rawls’s theory in relation to legal modernity and proposes an alternative solution that is more attentive to individual sovereignty, intersubjective relations, communication and democratization as process.
